Terms of Service

4.1 Credit Definition: One (1) Credit is required to perform one (1) forensic scan of a single Xactimate PDF document.

4.2 Credit Deduction Timing: Credits are deducted from your account balance upon successful generation of the Revenue Validation Report. No credits are deducted if the upload fails, the file is unreadable, or processing cannot be completed.

4.3 Credit Expiration: Credits do not expire and remain valid indefinitely unless your account is terminated for violation of these Terms.

4.4 Non-Transferable: Credits are non-transferable and may only be used by the account holder who purchased them.

5.1 Automatic Refund: Credit refunds are processed automatically within 24 hours of report generation when zero actionable omissions are identified.

5.2 Refund Eligibility: This guarantee applies only to completed scans that successfully generate a Revenue Validation Report. Technical failures or incomplete uploads are not subject to this guarantee as credits are not deducted in such cases.

5.3 Determination of Actionable Omissions: ESX-Ray reserves sole discretion in determining what constitutes an "Actionable Omission" based on IICRC S500 standards and industry best practices.

6.1 No Guarantee of Payment: The Service provides analysis and recommendations based on industry standards. Insurance carrier approval and payment decisions are beyond our control and subject to carrier-specific policies, claim-specific circumstances, and adjuster discretion.

6.2 Professional Judgment Required: Revenue Validation Reports are informational tools only. Users must exercise independent professional judgment in determining which identified items to include in revised estimates or supplement requests.

6.3 Limitation of Liability: To the maximum extent permitted by law, ESX-Ray shall not be liable for any indirect, incidental, consequential, or punitive damages, including but not limited to lost revenue, denied claims, or insurance carrier disputes, arising from your use of the Service.

6.4 Maximum Liability: Our total liability to you for any claims arising from the Service shall not exceed the total amount paid by you for Credits in the twelve (12) months preceding the claim.

6.5 "AS IS" Service: The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

7.1 Account Creation: To use the Service, you must create an account by providing accurate, complete, and current information, including a valid email address and password.

7.2 Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

7.3 Trial Incentive: New users may receive a complimentary credit upon email verification ("Trial Incentive"). This incentive is limited to one (1) per individual or entity.

7.4 Account Eligibility: You must be at least 18 years old and legally capable of entering into binding contracts to use the Service.

8.1 Multiple Account Prohibition: A single user or entity may not create, operate, or control multiple accounts for the purpose of receiving multiple Trial Incentives or circumventing credit purchase requirements.

8.2 Additional Prohibited Activities: You may not:

• Use automated systems or bots to access the Service
• Reverse engineer, decompile, or attempt to extract the Service's algorithms or methodologies
• Upload files containing malware, viruses, or malicious code
• Share account credentials with unauthorized third parties
• Resell, redistribute, or sublicense access to the Service
• Use the Service for any unlawful or fraudulent purpose

8.3 Enforcement: We reserve the right to investigate suspected violations, suspend or terminate accounts, and cooperate with law enforcement authorities when appropriate.

9.1 Credit Purchases: Credits may be purchased through our secure payment processor (Stripe). All prices are in U.S. Dollars (USD).

9.2 Payment Processing: By providing payment information, you authorize us to charge the applicable fees to your payment method. You represent that you have the legal right to use the payment method provided.

9.3 No Refunds: Except as expressly provided in Section 5 (Service Level Guarantee), all credit purchases are final and non-refundable.

9.4 Pricing Changes: We reserve the right to modify credit pricing at any time. Changes will not affect credits already purchased.

10.1 Termination by You: You may terminate your account at any time by contacting us. Unused credits will be forfeited upon account closure.

10.2 Termination by Us: We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or for any other reason at our sole discretion.

10.3 Effect of Termination: Upon termination, your right to access and use the Service will immediately cease. Sections that by their nature should survive termination (including Sections 6, 9, and 11) will remain in effect.
